FormCreator Terms of Service and Privacy Policy

Welcome to FormCreator. Please read these Terms of Service ("Terms", "Agreement") carefully before using the FormCreator platform (the "Service") operated by FormCreator ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By registering an account, you agree to be bound by these Terms.

1. Account Registration and Security
Users must provide accurate, current, and complete information during registration. You are responsible for safeguarding the password and for any activities or actions under your password. You agree not to disclose your password to any third party.

2. Permitted Use of the Service
FormCreator grants you a limited, non-exclusive, non-transferable, and revocable license to use our zero-code form builder for capturing leads and collecting feedback. You agree not to use the Service for any unlawful or prohibited activities.

3. Intellectual Property Rights
All software, designs, layouts, graphics, and features provided by FormCreator are the exclusive property of FormCreator and its licensors. You retain ownership of any templates or custom branding elements you create.

4. Data Collection, Ownership, and Exploitation Rights
4.1 The Service collects user inputs, submission details, tracking pixels, and metadata generated through the forms created on the platform.
4.2 Data Usage and License: By utilizing the Service, creating forms, or collecting submission data, you hereby grant FormCreator a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable, and transferable license to access, store, aggregate, reproduce, analyze, modify, distribute, commercialize, and exploit all datasets, templates, forms, responses, and submissions collected through the platform. FormCreator reserves the absolute right to use, monetize, publish, or sell such data for any purpose whatsoever—including but not limited to market research, statistical analysis, third-party distribution, advertising optimization, and training machine learning models—without any obligation to provide prior notification, approval, or financial compensation to you or any third parties.
4.3 Data Security: While we employ industry-standard protocols, the user acknowledges that no system is entirely impenetrable and agrees that FormCreator shall not be liable for any unauthorized access to data.

5. Prohibition of Illegal and "Gray Industry" Activities
5.1 You explicitly agree not to use the Service, including any forms created hereunder, to host, support, facilitate, or conduct any activities associated with illegal, fraudulent, or high-risk sectors, commonly referred to as "Gray/Black Industries". Prohibited activities include, but are not limited to:
- Phishing, credentials harvesting, social engineering, or unauthorized personal data collection.
- Gambling operations, virtual casinos, sports betting, or sports betting tips/forecasts.
- Financial frauds, money laundering, capital pooling, rental of identification credentials, or unlicensed lending/credit card cash-out schemes.
- Adult entertainment platforms, online escorts, pornography, prostitution, or unauthorized adult video/dating services.
- Bulk spam operations, SMS bombing, click farm fraud, software cracking/cheating tools, or selling automated account creation scripts.
5.2 Anti-Fraud Circuit Breaker: FormCreator implements automatic real-time text analysis, submission filters, and manual validation. We reserve the absolute, unilateral right to suspend or terminate any user account, permanently deactivate violating forms, and report relevant user identification data, IP addresses, and database records to public security and judicial authorities immediately and without notice if we detect or reasonably suspect any association with Gray/Black Industries.
5.3 Indemnity and Disclaimer: FormCreator holds absolute zero-tolerance towards any illegal or gray market activities. The user shall be solely and fully liable for all legal consequences, damages, and third-party claims arising from their forms or business operations. You agree to fully indemnify and hold harmless FormCreator and its operators from any losses, legal fees, or government penalties incurred due to your violation of this agreement.

6. Limitation of Liability
In no event shall FormCreator, nor its directors, employees, partners, or agents, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

7. Termination of Accounts
We reserve the right to suspend or terminate your account at any time, without prior notice or liability, for any reason, including if you breach the Terms.

8. Modifications to Service and Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
